ELY, Minn. (FOX 9) - Burning restrictions are officially lifted across Superior National Forest, and more of the Boundary Waters is opening back up — but fire crews are still hard at work.

July Lightning fires: Where things stand

What we know:

As of noon on Monday, Aug. 24, burning restrictions have been lifted across all three million acres of Superior National Forest, including the Boundary Waters Canoe Area Wilderness. The public is strongly encouraged to use extreme caution — any warm coals should be cold to the touch before being left unattended. Campgrounds and recreation sites currently under a closure order remain closed.

More than 1,600 of the roughly 2,000 Boundary Waters campsites — about 73% — are now available. On Tuesday, Aug. 25, two more entry points along the Echo Trail will reopen: Little Indian Sioux River South (Entry Point 9) and South Hegman Lake (Entry Point 77). The Superior National Forest's Alerts webpage has maps and updated information on recreation, closures and fire restrictions.

Fire-by-fire breakdown

By the numbers:

Seven July lightning fires have burned a combined 76,032 acres — 67,009 in the U.S. and 9,023 in Canada — with 598 personnel currently assigned.

  • The Camp Fire has burned 4,357 acres and is 97% contained, located five miles north of Winton.
  • The Sioux Fire has burned 6,833 acres and is 76% contained, north of the Echo Trail and east of Jeanette Campground.
  • The Bear Trap Fire has burned 39,327 total acres — 30,804 in the U.S. — and is 55% contained, located 20 miles north of Ely.
  • The Thumb Fire, which merged with the Wolfpack Fire over the weekend, has burned 25,515 total acres — 25,015 in the U.S. — and is 55% contained, located six miles south of Gakijiwanong Anishnaabe Nation, Canada.
  • The Little Knife Fire remains at 4,815 acres and is 90% contained with no threats to the perimeter and minimal fire activity.

A new fire was reported in the BWCAW on Sunday. The Muskeg Creek Fire, was spotted in the Caribou Point area of Pipestone Bay. Crews will be on scene Monday to assess the fire and resource needs.

Weather and what's ahead

Weather outlook:

Dry conditions continue Monday, with winds starting light out of the north in the morning before shifting as clouds increase through the afternoon and evening ahead of a low pressure system, according to the forest service update. That system will move through the region Tuesday, bringing more impactful weather and wetting conditions. There will be at least two chances for rainfall and thunderstorms Tuesday — the first in the morning and the second during the afternoon and evening as a front sweeps through the region.

What we don't know:

It is not yet clear how much rainfall the region will receive from Tuesday's system or how significantly the wetting conditions will affect active fire perimeters and ongoing suppression efforts.

Temporary flight restrictions remain in place over the fire area and continue to be updated as conditions change. A permanent flight restriction covers the Boundary Waters Canoe Area Wilderness. Visit the Federal Aviation Administration website for more information.

ICE agent extradition: MN sues TX Gov. Abbott

Time is running out in a dispute between Minnesota Gov. Tim Walz and Texas Gov. Greg Abbott regarding the extradition of an ICE agent accused of shooting a man in the leg and then lying about it. FOX 9's Paul Blume has the latest details and spoke with All Day's Courtney Godfrey about what comes next.  

(FOX 9) - Texas Governor Greg Abbott's office has responded to a lawsuit brought by Minnesota Attorney General Keith Ellison, seeking to force the extradition of an ICE agent involved in a Minneapolis shooting.

Abbott responds

What we know:

Last week, Ellison filed a federal lawsuit trying to force Texas to move forward with the extradition of ICE agent Christian Castro, who faces charges in Hennepin County related to the shooting of an immigrant in Minneapolis in January.

In his lawsuit, Ellison argued that the state is up against a crucial deadline this week, as Texas law only allows an individual to be held for a maximum of 90 days while awaiting extradition. Castro's 90 days expires this Thursday.

Ellison argued that there is evidence that Castro is a potential flight risk, citing jailhouse calls between him and a woman in Mexico where Castro discussed plans to buy a house in Mexico and live there with her.

Last week, Abbott responded to the lawsuit saying he didn't "trust Tim Walz on anything, let alone something like this." He also added he had "demands" of his own, calling on Minnesota to "repay the United States" for fraud.

What they're saying:

In his response, Gov. Abbott leans on three key arguments:

  • Because it's a state versus state matter, the Supreme Court should decide on the case: Abbott argues the District Court is the wrong venue for this case.
  • The lawsuit is not ripe because Abbott hasn't officially made a decision on the extradition.
  • Minnesota's case fails on its merits: Abbott's office states the Texas governor has the power to decide whether the conditions are met for the extradition. Abbott says he is waiting on a determination from his Secretary of State to determine if Castro meets the legal definition of a "fugitive."
  • Texas doesn't see Castro as a true flight risk and officials argue they could issue a "rendition" warrant and arrest Castro at a later date if all conditions are met for his extradition after the 90-day deadline expires.

For the "fugitive" aspect of the arguments, Abbott's attorneys say Castro didn't voluntarily leave Minnesota to avoid the criminal case. He was ordered to return to his home station by the Department of Homeland Security after Operation Metro Surge was wrapped up.

Abbott argues that if Castro was ordered to return to Texas, the mandatory duty to extradite him may not have been triggered. However, it's worth noting that, regardless, the Hennepin County judge has issued a warrant for Castro's arrest in the case and the reason Castro is in jail is because of that warrant.

What's next:

An emergency hearing is set for Tuesday in Brownsville, Texas on the lawsuit ahead of Castro's potential release on Thursday. The judge in the case could issue a ruling this week that could block Castro from being freed from the Cameron County Jail.

The Cameron County Jail is located in Brownsville, which is a border town directly across from Matamoros, Mexico.

Castro case background

The backstory:

Castro was arrested in Cameron County, Texas in late May, shortly after he was charged in Hennepin County. However, despite efforts by Gov. Walz, Ellison, and the Hennepin County Attorney's Office, Governor Abbott has not signed the papers to move forward with the extradition.

Minnesota officials say the delay is unusual, and the extradition process is an "administrative" procedure. Last week, as the lawsuit was filed, Ellison pointed out that Gov. Abbott had signed off on at least three other extraditions requested by Governor Walz at the time that Castro had been in jail.

Local perspective:

Castro was charged by Hennepin County Attorney Mary Moriarty with multiple felony counts, including four counts of second-degree assault and falsely reporting a crime following the shooting of Venezuelan immigrant Julio Sosa-Celis in January during Operation Metro Surge. 

Sosa-Celis was shot in the leg during an incident on 24th Avenue North on January 14. Castro initially claimed he was attacked with a broom and shovel before firing his service weapon. However, surveillance video and witness testimony contradicted Castro's claims. Sosa-Celis's family said he was in the county legally under temporary protected status.

The shooting of Sosa-Celis came a week after the shooting of Renee Good and ten days before the shooting of Alex Pretti. Like the Good and Pretti shootings, the Sosa-Celis shooting sparked a night of unrest in the north Minneapolis neighborhood. The scene became so tense that federal government squads left behind at the scene were looted and vandalized that night.

Preservationists are working to save a unique Revolutionary War "witness tree."

The Associated Press reported that arborists project that the tree was roughly 50 years old on Sept. 8, 1781, when British and colonial forces fought during the Battle of Eutaw Springs — considered by historians to be the last open field engagement of the American Revolution.

Crews work to preserve historic tree 

Dig deeper:

The tree is 45 feet and has a 72-inch trunk with Spanish moss and a bright-green fern.  As the tree grew, the metal bands cut into the trunk and branches, in some places disappearing beneath a covering of bark.

And 50 years ago, lightning struck a section of the tree where the main trunk divides into two or more large branches, which split the tree nearly in two. Workers whipped the broad branches together with steel cables and chains.

According to The Associated Press, crews recently used an air tool to loosen the ground around the tree’s roots, then injected a mixture to add nutrients to the soil. 

Workers hammered small lightning rods into the main branches, connecting them with copper cables that meet on a copper rod hammered deep into the ground roughly 10 feet from the trunk.

Additionally, workers will install new cables, bolted into five main branches, to stabilize the tree before removing the old supports.

MINNEAPOLIS (FOX 9) - Drivers in the Twin Cities are feeling the pinch at the pump, and the numbers show it's only getting worse.

Gas prices climb sharply across the region

What we know:

According to GasBuddy's survey of 1,106 stations in the Twin Cities, the average price of gasoline has risen 18.2 cents per gallon over the last week, now sitting at $4.19 per gallon. That's 6.5 cents higher than a month ago and $1.18 more per gallon than this time last year.

The gap between the cheapest and most expensive stations in the Twin Cities was wide. The lowest price recorded Sunday was $3.60 per gallon, while the highest was $4.39 — a difference of 79 cents. Statewide, that spread was even larger, ranging from $3.46 to $4.85 per gallon, a difference of $1.39.

Nationally, the average price of gasoline rose 2.9 cents per gallon over the last week to $4.05 per gallon. That's 92.6 cents higher than a year ago, though it is down 5 cents from a month ago. GasBuddy compiles its national data from more than 11 million weekly price reports covering more than 150,000 stations across the country.

Neighboring areas are also seeing increases. Minnesota's statewide average is $4.13 per gallon, up 16.8 cents from last week's $3.96. Wisconsin is at $3.91 per gallon, up 3.1 cents from $3.88 last week. Sioux Falls is slightly lower at $3.90 per gallon, down 5.4 cents from $3.95 last week.

"Average gasoline prices moved higher in the majority of states over the last week, with fewer than 10 states seeing declines, while diesel surged nearly 17 cents per gallon nationally, leaving it less than 25 cents away from an all-time record high," said Patrick De Haan, head of petroleum analysis at GasBuddy. "Gasoline, while not at all-time records, is at its highest level ever recorded this late in the calendar year, meaning Americans could for the first time ever see a national average price of gasoline above $4 per gallon on Labor Day — eclipsing the previous record of $3.83 per gallon set in 2012."

"While some oil shipments are apparently getting through the Strait of Hormuz, the dominant force propping up both gasoline and diesel prices is increasingly the growing loss of Russian refinery capacity," De Haan said, "as continued Ukrainian attacks knock more facilities offline and constrain the global supply of refined fuels. Until that refining supply picture improves, both gasoline and diesel prices face continued upward pressure."

Diesel prices near record territory

By the numbers:

The national average price of diesel has increased 16.6 cents compared to a week ago, now standing at $5.584 per gallon — less than 25 cents away from an all-time record high.

Looking back over the past five years, Twin Cities gas prices on Aug. 24 tell a clear story of rising costs:

INDIANAPOLIS - Indiana's governor is calling for answers from utility provider NIPSCO as thousands of residents continue to experience power outages following severe weather that struck two weeks ago.

Braun steps in following prolonged outages

What we know:

Following two weeks of widespread power outages across northwest Indiana, Braun is stepping in to take action against NIPSCO. On Monday, Braun directed the Indiana Office of Utility Consumer Counselor (OUCC) to file a complaint and petition the Indiana Utility Regulatory Commission (IURC) to investigate NIPSCO, according to a statement put out by the Indiana governor.

Braun is prompting a thorough investigation of NIPSCO in light of the utility provider's response to the recent mass power outage. Part of the investigation will include looking into whether funding approved by state regulators for infrastructure and reliability improvements was spent as promised, according to the governor's statement.

What we don't know:

The precise timing of when power will be restored for NIPSCO customers impacted by the ongoing power outage is unknown. NIPSCO has provided estimated times of power restoration for several wider city areas in Northern Indiana, but has stated that they will "share more precise city-related estimated restoration times once damage assessments are complete," according to the NIPSCO website.

At the time of this article being written, NIPSCO provided an 11 a.m. CT Monday update, stating that 10,712 customers were currently without power and the total outages to date since Aug. 11 are 374,500. They plan to update the situation again at 4 p.m. CT Monday.

What they're saying:

Braun has commented on the ongoing situation, stating, "NIPSCO is a monopoly utility that Hoosiers pay every month with the expectation that it will use its considerable resources to maintain its system, prepare for severe weather and restore service as quickly as possible when disaster strikes. NIPSCO has failed to keep its end of the bargain," said Gov. Braun. "I’m directing the OUCC to file a complaint and petition the IURC to launch an investigation so we can determine whether NIPSCO did what it promised ratepayers and regulators it would do with the money it was given. Hoosiers deserve accountability."

Braun has also stated that "crews on the ground, representing both state agencies and utility workers, have done an extraordinary job. However, NIPSCO management has failed to deliver adequate solutions."

NIPSCO's Response

The other side:

When asked to respond to the governor’s comments Sunday, NIPSCO released the following statement:

"We have engaged additional contractor crews throughout our service territory and continue to bring in support from neighboring utilities and mutual assistance partners from across the country. Our teams are assigned to outages large and small, and we remain committed to reaching every affected customer in all of our communities. No outage is being overlooked, and no customer will be left behind as we continue this restoration effort."

The company said its employees have been "working around the clock" to restore power across the region and acknowledged that "the past several days have brought significant challenges for many of our customers and communities. We are deeply grateful for their patience as restoration and recovery efforts continue."

Just this weekend, ComEd, the utility company that covers much of northern Illinois, sent several crews to Northwest Indiana to assist NIPSCO in its power restoration efforts.

Class action lawsuit

Big picture view:

A class-action lawsuit is seeking to hold NIPSCO accountable as thousands of northwest Indiana residents endure prolonged power outages following severe storms on Aug. 11.

The Allen Law Group says thousands of northwest Indiana residents are seeking damages and changes to NIPSCO's vegetation management practices.

The lawsuit alleges NIPSCO failed to proactively trim trees and other vegetation around power lines, leading to outages that could have been prevented.

Attorneys say residents affected by the outages have reported spoiled food, flooded basements and health-related problems. The firm cited residents who were unable to use medical equipment, had medical care delayed or struggled with pain management during the outages.

The other side:

NIPSCO released the following statement, in part, last Friday in response:

"We strongly disagree with the characterization of NIPSCO’s vegetation management practices in the Amended Complaint and the various press conferences held by the law firm of Kenneth Allen Law Group. We will vigorously defend the company through the legal process."

GRAND RAPIDS TOWNSHIP, Minn. (FOX 9) - A woman was killed, and two others were seriously injured in a head-on crash in Itasca County over the weekend. 

Deadly head-on crash 

What we know:

Saturday’s crash happened around 4:35 p.m. on Highway 2 near 17th Avenue Northwest in Grand Rapids Township, according to the Minnesota State Patrol.

The pickup truck driver was heading west on Highway 2 and collided head-on with a driver traveling in the eastbound lanes.

The pickup truck driver, a 38-year-old woman from Deer River, and her 41-year-old passenger from Cohasset were taken to St. Mary’s Medical Center with life-threatening injuries. State Patrol says neither was wearing a seat belt.

The driver of the other vehicle, a 42-year-old woman from Cohasset, was pronounced dead at the scene. Authorities noted she was wearing a seatbelt at the time of the collision.

Authorities did not say what led to the crash, but alcohol is not suspected to be a factor.

NIH study suggests excessive daily screen time begins in infancy

A new study of nearly 750 Norwegian children found that higher smartphone use by a child’s primary parent was associated with slower growth in receptive vocabulary, while owning a digital device at ages 4 to 5 was associated with lower language scores at the start of the study.

The population-based cohort study followed 747 children from roughly age 5 to age 7, examining whether children’s screen habits and their parents’ screen use were associated with changes in receptive vocabulary and grammar. Researchers accounted for differences in parental education and household income.

The study, published in JAMA Pediatrics on August 17, used annual assessments of receptive vocabulary and grammar, including standardized measures of children’s ability to understand words and grammatical structures. Researchers also used latent growth modeling to distinguish children’s language levels at the beginning of the study from changes in those skills over time.

Parent smartphone use, child device ownership linked to language measures

Big picture view:

The findings were mixed. Most measures of screen use were not associated with children’s language growth. 

"It may be surprising to some that our study shows a weaker correlation between children's screen time and language skills than some previous studies have found," Øistein Anmarkrud, a professor and researcher of the study, told FOX Local. "We put our data through a very rigorous test and given that we also know children's language development is quite stable over time, we were actually a little surprised by the correlations we did find." 

However, two associations stood out: greater daily smartphone screen time by a child’s primary parent was linked to slower growth in children’s receptive vocabulary. Each additional hour of daily smartphone use by the primary parent was associated with 0.42 fewer points in children’s annual growth in receptive-vocabulary raw scores.

Also, children who owned a digital device had lower language and grammar scores at the starting point of the study. Children who owned a digital device at ages 4 to 5 scored an average of 5.13 points lower in receptive vocabulary and 4.56 points lower in receptive grammar at baseline than children who did not own a device.

"So one reflects a developmental trajectory association, the other reflects a baseline difference," Anmarkrud continued. "Children owning a device was associated with their language skills at the start of the study, not with how quickly their language grew over time. That is a meaningful difference: it tells us these 4- to 5-year-old children who own a digital device already scored a bit lower when we first measured them." 

He added, "It is also reasonable to assume that whether a child owns a digital device may to some degree reflect the child’s access to digital media and opportunities to use it without parental supervision." 

Findings did not link digital device use to language delays

Dig deeper:

The researchers emphasized that these findings do not establish that smartphones or digital devices directly cause language delays. In particular, the association between device ownership and lower language scores was observed at the start of the study rather than as a difference in subsequent language growth.

"One should obviously be cautious about giving very strong or definitive advice based on a single study," Anmarkrud explained. "A more general recommendation might be that parents should make thoughtful decisions about when their child gets a digital device of their own, how much freedom the child has regarding what the device is used for and when it is used, and whether the child uses the device independently or together with an adult." 

Screen use was measured only at the study’s onset; parents reported most screen-use measures; researchers did not assess what children watched or did on screens, whether they used them with an adult, or why parents used their phones.

But the findings add nuance to an ongoing debate about children and screens. Rather than suggesting that all screen use is harmful, the results indicate that the type and context of screen use may be important. Parental smartphone habits and children’s access to personal devices could provide useful information for parents and clinicians assessing factors associated with language development.

The researchers concluded that family-level screen use may be a meaningful consideration when evaluating children’s language development, while noting that further research is needed to better understand the relationships and determine why parental smartphone use may be associated with slower vocabulary growth.

"Screen use should be considered at the family level, not just in terms of how much time a child spends on a screen. Our findings suggest that parental smartphone use and children's device ownership may be meaningful indicators of risk for poorer language outcomes. So it is not only about the child's own screen habits, but also the broader digital environment in the home," Anmarkrud said.

    A 4-year-old child suffered “extensive injuries” after they were run over by a lawn mower Friday in central Minnesota.

    According to the Morrison County Sheriff’s Office, emergency crews first responded just before 1:30 to a home in Swanville Township, about half an hour southwest of Little Falls.

    Authorities say a 33-year-old man was operating a zero-turn lawn mower with the child sitting on the front platform. The child fell off and was run over while the blades were running.

    A helicopter airlifted the child to Children’s Minnesota Hospital in Minneapolis for treatment.

    The sheriff’s office continues to investigate the incident.

The Minnesota Department of Natural Resources lifted the Class III burning restrictions for Cook, Lake and the rest of St. Louis County at 12:01 p.m. Monday.

“While conditions have improved, we’re not done with fire danger this year, as fall is just around the corner,” said Karen Harrison, DNR wildfire prevention specialist, in a statement. “It’s important for people to continue following wildfire prevention tips such as proper campfire safety and using caution when doing outdoor activities that create heat or sparks.”
